Recent Ruling Regarding DACA Renewals

Last week, a Federal Judge in California issued an order to keep the DACA program in place while the Trump administration’s cancellation of the DACA program is being fought in the courts. The order says that those people who have had DACA in the past can apply to renew their DACA under the same rules that existed before the program was cancelled. Immigration can still make individual decisions to approve or deny renewal applications based on “fair discretion.” The court gives Immigration a “reasonable” amount of time to announce a process for people to apply to renew their DACA.We expect the Trump administration to appeal this decision. For those who have or have had DACA, we recommend a consultation with an immigration attorney to talk about your options.As of 1/16/18: USCIS has announced that DACA recipients may now submit renewals. “Due to a federal court order, USCIS has resumed accepting requests to renew a grant of deferred action under DACA.
