With a New Year, New Anti-Immigrant Policies Enacted

2023 has barely begun, and the Biden Administration has already announced plans to further restrict immigration and deny thousands of asylum claims, which is a fundamental human right enshrined in both U.S. and international law.Following the U.S. Supreme Court’s decision to uphold Title 42 in December, the Biden Administration now seeks to further expand the program. Enacted by the Trump Administration under the guise of protecting public health, Title 42 enabled U.S. authorities to wrongfully expel 2 million migrants seeking asylum, leaving hundreds of thousands stranded in Mexico.“The U.S. Government has said that these actions will limit ‘illegal’ border crossings. But the only illegal actions are these restrictions on human rights,” said ICS’s Executive Director, Frank Garcia. “Denying asylum is not only unlawful but also deeply immoral and places the lives of immigrants and refugees in grave danger.”The Biden Administration also announced a small expansion of a humanitarian parole program, which would allow entry for 30,000 migrants from Cuba, Haiti, Nicaragua, and Venezuela. While this is a positive step, the policy offers only a narrow pathway for migrants with existing ties in the U.S. and/or financial support. Title 42 will continue to exclude the most vulnerable from entering the U.S. to seek safety.These actions also follow the failure of the U.S. Congress to deliver a pathway for immigrant youth under the Deferred Action for Childhood Arrival (DACA) program by the end of the 2022 legislative session. The futures of DACAistas will once again hang in the balance.“We need permanent protections for hundreds of thousands of DACAistas nationwide and 10,000 in Oregon alone.
